Terms of Service

Last updated 14 August 2026.

These terms are the contract between you and IHAR FINCHUK, trading as GYMMER (VAT/tax no. PL5223211274), a sole trader registered in Poland, at ul. Floriańska 6/02, 03-707 Warszawa, Poland — referred to below as "we" and "us". By creating an account you agree to them. If you are a consumer in the EU, nothing here removes rights your own country's law gives you — where these terms and that law disagree, that law wins.

What GYMMER is

GYMMER is a training log. You record workouts, track progress over time, set goals, and can ask an AI coach for suggestions. That is the whole of what we promise to provide.

GYMMER is not medical advice

This is the most important clause here, so it is not buried at the bottom.

GYMMER is a fitness and wellbeing tool. It is not a medical device, it does not diagnose, treat, cure or prevent any condition, and neither the app nor the AI coach gives medical advice. Suggestions about training, load or recovery are general information, generated without knowing your medical history.

Exercise carries risk of injury. Before starting or changing a training programme — particularly if you are pregnant, recovering from injury or illness, or have a heart, joint, metabolic or other condition — consult a qualified doctor or physiotherapist. If something hurts, stop. Do not use GYMMER as a substitute for professional care, and never disregard medical advice because of something the app told you.

You are responsible for how you train. Within the limits set out below, we are not liable for injury arising from your training decisions.

Your account

You must be at least 16 to hold an account. Give accurate registration details, keep your password to yourself, and tell us promptly at mail@gymmer.com if you think someone else has access. One account is for one person; do not share it.

Your training data is yours. We claim no ownership over what you log, and you can export or delete it at any time.

Acceptable use

Do not break the law with GYMMER, do not try to breach or overload our systems, do not scrape or resell the service, and do not use the AI coach to generate unlawful or abusive content. We may suspend an account that does these things; where the account is not being used to cause active harm, we will warn you first and give you a chance to put it right.

Paid features, if you buy them

Some features may require payment. Before you pay we will show you the total price including VAT, what you get, how long it lasts and whether it renews. Subscriptions renew for the same period unless you cancel before the renewal date. Cancelling stops the next renewal; it does not shorten the period you have already paid for.

Your right to withdraw — and how you can lose it

As a consumer in the EU you normally have 14 days to withdraw from a distance contract, without giving a reason, under the Consumer Rights Directive.

For digital services there is an exception you should understand before you buy. If you ask us to start providing a paid service immediately — inside the 14 days — and you acknowledge that doing so costs you the withdrawal right, then once the service has been fully provided you can no longer withdraw. We will ask for that acknowledgement explicitly at the point of purchase. If you do not give it, your service begins after the 14 days.

To withdraw, tell us at mail@gymmer.com within the period. A clear statement is enough; there is no form to find. We refund within 14 days of being told, by the same means you paid.

Availability

We aim to keep GYMMER available, but we do not guarantee uninterrupted service. We may take it down for maintenance, and will give notice where we reasonably can. We may change or discontinue features; if a change removes something material you paid for, you may cancel and we will refund the unused part.

Ending the contract

You may delete your account at any time, from within the app. We may terminate for a serious or repeated breach of these terms, or if we stop operating GYMMER — with reasonable notice, and a refund of anything you have paid for and not received. On termination we delete your data as described in the privacy policy.

Our liability

We do not exclude or limit liability for death or personal injury caused by our negligence, for fraud, or for anything else the law does not allow us to limit. Any attempt to read this section as doing so fails.

Subject to that, we are liable for foreseeable loss caused by our breach of these terms or our failure to use reasonable care. We are not liable for loss that was not foreseeable, for loss arising from your own training decisions, or for business losses — GYMMER is supplied for personal use.

Nothing here affects your statutory rights as a consumer, including the right to a service supplied with reasonable care and skill.

Complaints and disputes

Contact us first at mail@gymmer.com; most problems are a misunderstanding and we would like the chance to fix it. If we cannot resolve it, you may bring a claim in the courts of your own country of residence, and you may be able to use an alternative dispute resolution body there. We are not obliged to use any particular ADR scheme, and will tell you if we agree to one.

Governing law

These terms are governed by the law of Poland. If you are a consumer, this does not deprive you of the protection of the mandatory rules of the country where you live, and you keep the right to sue in your local courts.

Changes to these terms

We may update these terms. If a change materially affects your rights or obligations we will give you reasonable notice by email or in the app before it takes effect, and you may end the contract if you do not accept it. Continuing to use GYMMER after that notice means you accept the new terms.
